When to use it
Use when a NSW liquor licence is to move to a buyer or a new licensee as part of a sale, or when the current licensee will not consent and the owner needs an owner-in-possession transfer. Do not use it as the application itself. Lodge through Liquor & Gaming NSW's current online form.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may build the evidence index and a first draft of the sale conditions from the contract and the licence extract. The lawyer chooses the transfer pathway and checks every statement before anything is lodged.
AI may
- List which of the four transfer pathways the facts appear to fit, with the missing document for each
- Build an evidence index from the contract, ASIC extract, police certificate, RSA and RCG records and the direct debit form
- Draft sale-contract conditions that the licence transfer is a condition of completion, using the bracketed options
AI must not
- Must not choose the pathway, or say the incoming licensee is fit and proper
- Must not state that provisional approval has issued, or that the buyer may trade, unless that is in a Liquor & Gaming NSW notice on the file
- Must not lodge the transfer or sign a TDEC declaration
The lawyer checks
- The pathway matches the facts: consent, owner in possession, death disability or bankruptcy, or notice of transfer
- Completion is not fixed on a date before provisional approval, because the transfer is not effective until that approval
- RSA, RCG where gaming machines are on the licence, a police certificate under three months old, and the ASIC extract for a company licensee are on the file
- If the proposed licensee is an organisation, a manager appointment is in the application
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
