Where this comes from
The official form is published by sa.gov.au; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use on a family file when a name is to be registered in South Australia, including a child's name, or when the page's marriage rule is in issue. An Australian marriage in which a partner's surname is taken, or the pre-marriage surname is resumed, does not need CBS registration. The tool does not write the declaration or the reason.
Used for these tasks
- Draft a parenting plan or parenting orders from the arrangements sheet
- Turn existing parenting orders into a practical arrangements sheet
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may check eligibility, the marriage exception, and the fee the page states. The lawyer writes the declaration and the reason, and checks the application before it is lodged.
AI may
- Check birth in South Australia, or the overseas-birth residence test the page states
- Flag an Australian marriage surname change, which the page says does not need CBS registration
- List the fee line that applies: $322.00, or $144.00 for an order of a court or tribunal
AI must not
- Must not draft the declaration or the reason for the change
- Must not draft a parenting plan or parenting orders
- Must not add a fee, a limit or an identity document the page does not state
- Must not sign, witness or lodge the application
The lawyer checks
- The page says declaration. It does not say statutory declaration. If the current file is a statutory declaration, the tool writes nothing in it
- The declaration is signed before a registry approved witness. The full witness list was linked and not opened
- One change in 12 months, and three changes in a lifetime, are checked, with the permission categories the page names
- The processing-times page was not opened
- The lawyer checks the current South Australian generative-AI guideline. None was stated on the page opened for this guide.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
