Where this comes from
The official form is published by fcfcoa.gov.au; this page is a completion guide. Last checked on 2026-10-18.
When to use it
Use when parties have agreed parenting, financial or property arrangements and want the Federal Circuit and Family Court to make orders by consent without a contested proceeding, or to vary or discharge existing orders by consent.
Used for these tasks
- Prepare the retirement-benefit or superannuation-splitting steps list
- Draft a parenting plan or parenting orders from the arrangements sheet
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may help draft the proposed orders inside the firm's settled order precedents and check the application against the kit checklist; the lawyer checks every order, every disclosure answer and the superannuation steps in each matter.
AI may
- Draft proposed orders from settled terms using the firm's approved order precedents, for the lawyer to check line by line
- Check the completed application against the kit checklist and list unanswered questions and unticked Statement of Truth boxes
- Cross-check asset and liability figures in the application against the disclosure schedule and list differences
- Build the superannuation trustee notice timetable (28-day notice, objection period, filing date) for the lawyer to diarise
AI must not
- Must not decide whether the orders are just and equitable or in the best interests of the children
- Must not calculate a superannuation interest value or base amount that is not checked against the Regulations and the fund's statement
- Must not complete or sign the Statement of Truth or the statement of independent legal advice
The lawyer checks
- Orders are within power, binding on third parties only where the Act allows, and enforceable as drafted
- Superannuation splitting: 28-day notice served on the trustee, no objection received, proof of value attached, and liberty to apply included
- Leave sought as the first order and consent given at Question 10A if outside the s 44 time limit
- Application filed within 90 days of the first signed Statement of Truth
- Notice of child abuse, family violence or risk filed where parenting orders are sought
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
