When to use it
Use from the pre-action stage until the case is finalised, and again whenever circumstances change or further documents come into a party's possession, power or control. It records the duty. It is not the Financial Statement, the undertaking, or an affidavit.
Used for these tasks
- Prepare the financial statement and the disclosure index
- Find missing financial disclosure documents
- Identify financial changes that need a disclosure update
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may sort the file into this index and flag a date that has passed; the lawyer decides what is relevant, what is a protected confidence, and what is actually given to the other party.
AI may
- Build the index from documents already on the file and mark each item given, missing or withheld
- Calculate the 21-day date from a recorded change in financial circumstances
- List the brochure's examples of parenting documents so the lawyer can say which ones exist
AI must not
- Must not draft the disclosure undertaking, a Financial Statement, or any affidavit, including an affidavit of further particulars or a short updating affidavit
- Must not decide that a document is irrelevant, privileged, or a protected confidence
- Must not send the index, or any document on it, to the other party
The lawyer checks
- The index covers total direct and indirect financial circumstances, including interests held through another person or an entity, where the case is financial or property
- Disposals in the year before separation and since final separation are asked about, where they may affect a claim
- A change after the Financial Statement is filed is diarised for an amended Financial Statement, or for the short affidavit the Rules allow, within 21 days
- Parenting material is screened for a protected confidence before anything is produced, and any expert report obtained for a parenting case is copied to the other parties and the independent children's lawyer
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
