Where this comes from
The official form is published by supremecourt.wa.gov.au; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use when asking the Supreme Court of Western Australia for default judgment in an action for a liquidated demand, on Form 32. The lawyer confirms the rules' preconditions. This guide does not state them. A District Court document with the same title is a different file.
Used for these tasks
- Check the claim pack against the current form, fee and registry rules before filing
- Draft particulars of a liquidated claim
- Assemble the service evidence before asking for default judgment
- Draft default or summary-judgment papers from the liquidated file
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may check Form 32 is the current Supreme Court form and list service documents already on the file; the lawyer decides whether default judgment is available and writes the judgment.
AI may
- Check the draft is Supreme Court Form 32, not the District Court file of the same name, and list blank fields
- Index affidavits of service and the claim already on the file, with dates, without rewriting them
- Flag if the claim on file is described as unliquidated, so the lawyer can consider a different form
AI must not
- Must not decide that default judgment is available, or draft the judgment sum
- Must not draft an affidavit of service or any other affidavit
- Must not state a time to respond unless that time is taken from a rule the lawyer has opened
- Must not sign or file the judgment
The lawyer checks
- Order 13 rule 2 and Order 42 rule 1, as cited on the forms table, still apply and their preconditions are met
- The demand is liquidated, and the amount matches the claim
- Service evidence is on the file before the judgment is filed
- Two copies are prepared, as the forms table states
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
