Where this comes from
The official form is published by mcv.vic.gov.au; this page is a completion guide. Last checked on 2026-10-18.
When to use it
Use when starting a civil claim, including a debt claim, in the Magistrates' Court of Victoria under the Magistrates' Court General Civil Procedure Rules 2020.
Used for these tasks
- Draft particulars of a liquidated claim
- Check the claim pack against the current form, fee and registry rules before filing
- Draft default or summary-judgment papers from the liquidated file
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may draft the particulars of a liquidated claim from the contract, invoices and ledger and check the claim pack against the court's forms; the lawyer checks every figure and allegation in each claim, and the service affidavit is the server's own sworn evidence.
AI may
- Draft the particulars of the debt (contract, invoices, payments, balance, interest) from the ledger and documents, for the lawyer to check line by line
- Reconcile the amount claimed, interest and costs to the ledger, with a source for every figure
- Check the claim pack against the current forms, copies and filing steps, and list gaps
- Calculate the service, response and default dates from the filing and service dates, for the lawyer to diarise
AI must not
- Must not decide whether the claim is in time, in the right court, or against the right defendant
- Must not draft the affidavit of service or any other sworn evidence
- Must not sign, file or serve anything
The lawyer checks
- Plaintiff's address for service (within Victoria if suing in person) and email address for service
- Lawyer's details, and any representative capacity of the plaintiff or defendant
- Statement of claim attached, with the debt, interest and costs correctly stated
- Amount and costs in the notice to the defendant match the statement of claim
- Two copies of the notice of defence (Form 8A) served with the complaint
