When to use it
Use when a general procedure claim in the Magistrates Court of Western Australia requires a statement of the claim in civil Form 19. Do not use it as the minor case claim, and do not use the civil judgments Form 19 by mistake.
Used for these tasks
- Check the claim pack against the current form, fee and registry rules before filing
- Draft particulars of a liquidated claim
- Decide whether the claim is in time and in the right court
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may check a draft against civil Form 19 and list gaps; the lawyer writes the statement of claim and the particulars.
AI may
- Check the draft against the current official form and list blank fields, missing attachments and inconsistent party names
- Flag when the proceeding looks like a motion, summons, judicial review or other process that uses a different form
- List the copies, layout and registry details stated on the court page that was opened
AI must not
- Must not draft the indorsement, statement of claim, grounds or any affidavit
- Must not decide which court has jurisdiction, the monetary limit, or whether the claim is in time
- Must not sign, file or serve the document
The lawyer checks
- The current form is the one prescribed for this kind of proceeding in this court
- Parties, court heading and relief match the instructions
- Any pre-action step, fee and practice direction is checked against the current rules
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
