Where this comes from
The official form is published by ucprforms.nsw.gov.au; this page is a completion guide. Last checked on 2026-10-17.
When to use it
Use when the debtor has not paid or responded to a letter of demand and the claim is for a fixed sum in NSW. Download the current approved forms on the day. Do not use where the debt is genuinely disputed in a way that needs a fuller pleading.
How AI may be used
AI may help populate the particulars of a liquidated claim from the contract, invoices and ledger, and check a completed claim pack against the form and registry requirements, but the lawyer settles the pleading, and no AI is used to generate the content of any affidavit.
AI may
- Populate particulars of the debt (invoices, dates, payments) from a reconciled ledger
- Check the completed form for blank fields, stale form versions and mismatched party details
- Calculate interest from the rate and periods the lawyer specifies, showing the arithmetic
AI must not
- Must not generate or rephrase any content of the affidavit of debt or affidavit of service
- Must not choose the court, the cause of action or the defendant's legal identity
- Must not file anything
The lawyer checks
- The defendant's exact legal name and address for service are verified
- The amount, interest calculation and costs claimed are correct and allowed
- Service complies with the rules for that kind of defendant
- Affidavits include the Gen AI disclosure required by SC Gen 23 para 13
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
