When to use it

Enclose it with the costs update notice when the figures on a plaintiff personal injury file are revised. Use it in New South Wales, Victoria or Queensland. Do not use it as the opening estimate, as the bill, or as the disclosure signed before a settlement.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool can lay out the table. The lawyer enters every figure, decides the variables, and decides whether the client's signature is one of the steps that satisfies section 174(3).

AI may

  • Build the table with blank amounts for professional fees, records, medico-legal reports, counsel and other disbursements
  • Keep the New South Wales and Victorian acknowledgement separate from the Queensland acknowledgement
  • Refer a Queensland speculative cap to the cap worksheet

AI must not

  • Must not insert a dollar amount, a range, or a total
  • Must not treat the client's signature as all of the reasonable steps in section 174(3)
  • Must not ask a Queensland client to consent because section 315 requires consent
  • Must not calculate a speculative-costs cap

The lawyer checks

  • Every figure matches the lawyer's revised estimate and the update notice describes the same change
  • On a Uniform Law file, the lawyer records what was done, besides the signature, to be satisfied the client understood and consented
  • On a Queensland file, the letter is part of the written disclosure under section 315 and the signature is a record of receipt
