When to use it
Use when checking a document that promises what a business will do if goods or services go wrong. The promise is in addition to the consumer guarantees. This checklist does not create the warranty.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may compare a draft with the contents list and the mandatory text on the ACCC page and mark any missing item, and the lawyer settles the warranty and does not allow the mandatory text to be changed.
AI may
- Mark which of the page's required items appear in the draft
- Compare the mandatory paragraphs in the draft with the wording on the page and mark any difference
- Record whether the draft is for goods, for services supplied after 9 June 2019, or for both
AI must not
- Must not change the mandatory text
- Must not decide the warranty period, the claim steps, or who pays expenses
- Must not say that the consumer guarantees are limited by the warranty
The lawyer checks
- The correct mandatory text is included exactly, for goods, services, or both
- The business name, address, email and telephone number are the business that gives the warranty
- Nothing else in the document limits or negates the mandatory text
- The mandatory information is available with the product, not only on a website or in store
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
