When to use it
Use when a supply or distribution arrangement sets, recommends, or reacts to the price at which goods or services are resold. It does not decide that the arrangement is resale price maintenance.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may quote the price clause and match it to an example on the ACCC page without concluding that the clause is unlawful, and the lawyer decides whether the Act is engaged and whether an exemption is needed.
AI may
- Extract the price, discount and refusal clauses from the agreement
- Note which ACCC example the clause resembles, using the page's words
- Record whether the file contains an authorisation or a notification
AI must not
- Must not decide that the conduct is resale price maintenance
- Must not treat a recommended price as lawful, or as unlawful, from the label alone
- Must not draft an authorisation or a notification
The lawyer checks
- The clauses are read against sections 48 and 96 to 100, which the page names and which were not opened
- A recommended price, a maximum price, and a refusal for loss-leader selling are distinguished using the Act, not only this page
- Any exemption is an authorisation or a notification that is in force, not a proposed one
