When to use it

Use when a Queensland farm mortgage is heading toward mediation or enforcement, and the QRIDA notices and times need to be tracked. Do not use it as a New South Wales mediation notice, or as the heads of agreement. The approved forms were not opened.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may enter the date a notice was served and count the business days the QRIDA page states. The lawyer decides whether the debt is in the Act and whether enforcement is available.

AI may

  • Record service of an inviting notice and count 20 business days for a request, and 30 business days for documents
  • List the three mediators the farmer nominates, by reference to the register, without copying a standing list of names
  • Diary the 10-business-day cooling-off period after a heads of agreement, and the 20-business-day show-cause periods

AI must not

  • Must not decide that the farmer or the debt is within section 11. The page says to review the criteria and does not set them out
  • Must not say enforcement may proceed, or draft a heads of agreement or a notice
  • Must not describe the New South Wales farm-debt scheme. This checklist is Queensland only
  • Must not disclose what was said at the mediation. The page cites section 38

The lawyer checks

  • The mortgage is a farm mortgage and the debt is a farm business debt, decided against section 11 rather than assumed
  • Business days are counted as the page states: the farmer's 20 days start after the day the inviting notice is served
  • A heads of agreement is not treated as final during the 10-business-day cooling-off period
  • An internal review is diarised within 20 business days from the day notice of the decision was given, and section 77(2) is applied before anyone acts on the original decision

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
