When to use it
Use on a farm sale or a stand-alone water trade in NSW, to confirm what is being traded, which approvals and consents are needed and what must be lodged at settlement. It separates the licence (share component) from the allocation in the water account.
How AI may be used
AI may extract licence, folio and allocation details from the registers into the schedule; the lawyer works through the checklist and decides what is being traded, which consents are needed and whether the dealing can proceed.
AI may
- Extract water access licence numbers, tenure type, share component, holders, mortgages, caveats and notations from WAL folios into Part A
- Extract allocation balances and works approvals from WaterNSW statements into the schedule
- Compare the contract's water schedule with the folio details and list differences
AI must not
- Must not decide whether water sharing plan rules, trading zones or limits allow the dealing
- Must not complete or lodge dealing forms or applications, or state the agreed price to the approval authority
- Must not treat an allocation balance as transferring with the licence unless the contract and the dealing provide for it
The lawyer checks
- Each WAL is identified by number and tenure type exactly as on the folio, and the transferor's name matches the registered holder
- Mortgagee or chargee consent and any Minister's consent noted on the folio are obtained, and caveats are dealt with
- Whether the trade is a licence transfer, an allocation assignment, a term transfer or a change to nominated works, and the right form for each
- The water sharing plan rules and any trading restrictions have been checked with WaterNSW before exchange
