Eligible interest-holder consent checklist for an ACCU project

A checklist of whose consent is needed before an area-based ACCU project can receive units, what that consent does not do, and when a project can be registered without every consent in hand. The consent form is not signed here.

When to use it

Use when an area-based emissions-avoidance or sequestration project needs eligible interest-holder consents, or when area is being added. Do not use it as the consent form. The consent-guidance PDF and the legal-right page were not opened.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may list interest-holders from the title search and mark which consent is missing. It must not sign the consent, or say the project is eligible or that a carbon right has been assigned.

AI may

  • List landholders, mortgagees, Crown lands ministers, registered native title bodies corporate and easement holders shown on the searches
  • Record whether each consent is attached, deferred under conditional registration, or avoided by excluding an easement from the map
  • Record that an Indigenous land use agreement already contains the consent, if the lawyer has identified a registered agreement

AI must not

  • Must not sign the consent form, or say consent can be withdrawn after registration
  • Must not treat consent as a legal right to run the project, as an assignment of carbon sequestration rights, or as a promise of units
  • Must not decide that free, prior and informed consent has been given. The page says the principle should be considered on native title land
  • Must not apply a method rule. Method pages were not opened, including the closed Western Australian method pages

The lawyer checks

  • The project is an area-based emissions-avoidance or sequestration project. Other project types are outside this page
  • Every eligible interest-holder in sections 43 to 45A has been identified from the Act, not only from the examples on the page
  • Conditional registration is acceptable only if all outstanding consents will be in before the first reporting period ends, and no units are expected before then
  • A blue-carbon project uses CER-ACCU-BC001 or CER-ACCU-BC002, not the general form, if that is the method

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
