When to use it
Use for commercial agistment of cattle, sheep or goats on NSW land. Do not use for share-farming, livestock leasing or sale on terms; adapt the biosecurity and NLIS clauses for other states.
How AI may be used
AI may adapt the agreement to the stock, property and fee details, but PPSA registration, lien and biosecurity points must be confirmed by the lawyer for the state where the stock are held.
AI may
- Populate the schedules from the parties' instructions, NVDs and NLIS records.
- Produce a plain-English summary of each party's obligations for the client.
- Compare a counterparty's agistment terms with this precedent and list differences.
AI must not
- Must not decide whether a PPSA registration is needed or whether the agreement is a PPS lease.
- Must not set fees or carrying capacity.
- Must not draft a power of sale over the stock without the lawyer's instruction.
The lawyer checks
- Whether the agister provides value (s 13(3)) and whether any lien clause creates a security interest that should be registered.
- NLIS, PIC and movement documentation requirements in the state where the stock are held.
- If either party is a small business using standard terms, the unfair contract terms rules.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
