When to use it
Use after an initial succession meeting with a NSW farming family to confirm instructions and next steps. Do not use as the will or transfer documents, or where the family has not yet agreed who the firm acts for.
How AI may be used
AI may summarise a recorded family meeting if everyone present consented, and draft this letter's factual sections, but family provision, tax and duty advice is for the lawyer and the accountant.
AI may
- Produce a summary of the meeting from the recording or notes, if all participants consented to recording and AI transcription.
- Draft the asset and structure schedule from title searches, financial statements and trust deeds.
- Prepare a first draft of the letter's background and options sections for the lawyer to revise.
AI must not
- Must not record or transcribe a family meeting without the informed consent of everyone present.
- Must not state family provision risk, CGT outcomes or duty eligibility as conclusions.
- Must not send or share the summary with family members who are not clients.
The lawyer checks
- Who the firm acts for is clear and any conflict between family members has been managed.
- Family provision exposure, including notional estate, has been assessed for each eligible person.
- Tax and duty statements have been checked with the client's accountant against current law.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
