When to use it
Use when a farmer acquires connected machinery, sensors, farm management software or agronomy services that collect farm data or give AI-generated recommendations. Adapt for provider-side use. Do not use as a substitute for a privacy policy where personal information is collected.
How AI may be used
This clause is AI-specific. AI may help compare provider terms against it, but the lawyer must decide what the farmer can realistically negotiate and how it interacts with the provider's licence and privacy terms.
AI may
- Compare a provider's data terms and privacy policy with this clause and list gaps and conflicts.
- Map the provider's terms against the six Farm Data Code principles.
- Produce a plain-English summary of the provider's data rights for the farmer.
AI must not
- Must not state that the provider's terms are unfair or unenforceable.
- Must not draft provider warranties about agronomic outcomes that the provider has not offered.
- Must not upload the farmer's yield, financial or location data to an AI tool to test the clause.
The lawyer checks
- Whether the provider is certified under the Farm Data Code and what its terms actually permit.
- Whether farm data includes personal information (for example, sole trader or employee data) and the Privacy Act applies.
- That the AI-recommendation clause allocates responsibility consistently with any consumer guarantees and the contract's liability caps.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
