How AI is used
From the dates the lawyer supplies, build a timetable of the 60-day period and a checklist of the notice recipients in § 2102. Do not decide whether a plant closing or a mass layoff has occurred.
What the lawyer must review
29 U.S.C. § 2102: an employer shall not order a plant closing or mass layoff until the end of a 60-day period after written notice to each representative of the affected employees as of the time of the notice or, if there is no such representative, to each affected employee, and to the State or entity designated by the State to carry out rapid response activities, and to the chief elected official of the unit of local government within which the closing or layoff is to occur. The employer may order the shutdown of a single site before the end of that period if, as of the time notice would have been required, the employer was actively seeking capital or business which, if obtained, would have enabled the employer to avoid or postpone the shutdown, and the employer reasonably and in good faith believed that giving the required notice would have precluded obtaining that capital or business. The employer may order a plant closing or mass layoff before the end of the period if it is caused by business circumstances that were not reasonably foreseeable as of the time notice would have been required. No notice under the chapter is required if the closing or layoff is due to a natural disaster such as a flood, earthquake, or drought. An employer who relies on that subsection gives as much notice as is practicable and, at that time, a brief statement of the basis for reducing the notification period. You decide whether there is a plant closing or a mass layoff only after you open § 2101, which defines those terms. Do not use an employee-count figure that § 2102 does not state.
