Prepare the facts for an exemption question, without a coverage opinion

Key facts

How AI is used
Table each worker's duties, hours and pay from the records the lawyer supplies. Write no statement that a worker is covered or exempt.
What the lawyer must review
You write any fact sheet that says who is covered. Section 213(a) includes an employee employed in a bona fide executive, administrative or professional capacity, or as an outside salesman, as those terms are defined by regulations of the Secretary. You open the current regulations before any conclusion. A job title does not decide it. Section 207 states the overtime rule for hours over 40 in a workweek, with exceptions. State wage law can be stricter. Nothing in the table is a coverage opinion.
