Reconcile payroll evidence before calculating overtime back pay
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Build a week-by-week table of hours, rates and amounts paid from the payroll records the lawyer supplies, and flag weeks over 40 hours and gaps in the records.
- What the lawyer must review
- 29 U.S.C. § 207 generally requires pay of at least one and one-half times the regular rate for hours over 40 in a workweek, and the section sets out exceptions and a definition of the regular rate. You decide whether an exception applies, by opening it, and you decide the regular rate. State wage law can require more. Check every total against the source record before a figure is used in a demand or a filing. Do not put payroll records into a public tool (Model Rule 1.6).
