- In California, Labor Code § 2922 says employment with no specified term may be ended at the will of either party on notice, and a specified term means a period greater than one month. Business and Professions Code § 16600 makes a contract that restrains anyone from a lawful profession, trade or business void to that extent, except as that chapter provides, and says it is read broadly so that a noncompete in an employment contract is void unless an exception in the chapter applies. Other states do not copy those two sections. Where the Fair Labor Standards Act applies, check wage and hour terms against 29 U.S.C. § 207, including any exception in that section you actually open. Read every clause before the contract is signed.
