When to use it
Use when a lawyer is comparing a summary plan description with 29 U.S.C. § 1022. Do not use it as the summary that is furnished, and do not use it to state a furnishing deadline.
Used for these tasks
- Compare a member booklet or product disclosure to the deed
- Compare a self-managed retirement-fund deed to a current-law checklist
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
Yellow: the lawyer compares each statutory item with the booklet and the plan instrument.
AI may
- List the items section 1022(b) says the summary plan description shall contain.
- Record the accuracy and plain-language standard in section 1022(a).
- Leave names, addresses, and benefit descriptions blank for the plan's own text.
AI must not
- Do not furnish a summary plan description.
- Do not state a deadline for furnishing. Section 1024(b) was not opened.
- Do not define group health plan or health insurance issuer. Section 1191b was not opened.
- Do not calculate a benefit or write a claims decision.
The lawyer checks
- Compare the booklet with the plan instrument, not only with this list.
- Read section 1024 before stating when the summary or a material modification is furnished.
- Read section 1133 before describing the claims remedy it requires.
- Do not add a Department of Labor office address. The statute names the office and this list does not supply a street address.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
