When to use it
Use before a trustee or administrator releases AI-generated member content or a member-facing chatbot, after any material change, and when advising a trustee on AI governance. Not a substitute for the trustee's own risk framework or advice licensing review.
How AI may be used
AI-specific: tests whether AI outputs cross from factual information into personal advice, mislead members or lack required warnings before release. AI may pre-screen, but people complete the checklist and approve release.
AI may
- Pre-screen draft communications and chatbot transcripts for advice language, figures and high-risk topics
- Generate test questions for the chatbot, including advice-seeking and complaint scenarios
- Compare stated figures with a lawyer-supplied table of current official figures
AI must not
- Must not approve content for release or sign off any section
- Must not decide whether content is personal advice
- Must not be given member TFNs or health information to test the tool
The lawyer checks
- The advice boundary analysis in section 2 for each use case
- That figures and rules statements match current official sources and the fund's documents
- That complaint, vulnerability and death benefit hand-offs work in testing
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
