When to use it
Use when an SMSF member who has met a condition of release asks the trustee to start an account-based pension. Read the fund deed first: the pension must be permitted by, and paid under, the deed's rules. For a transition to retirement income stream, add its maximum payment limit.
How AI may be used
AI may fill the request and minutes from the member's details, valuation and member statement and work the first-year minimum from figures supplied; the adviser or lawyer checks the condition of release, the deed, the reversionary choice and the calculation before the trustees sign.
AI may
- Fill names, dates, the start-day balance and tax components from the valuation and member statement
- Work the pro-rata first-year minimum payment from the balance, age and start day, showing the calculation
- List the TBAR reporting and payment dates that follow from the start day
AI must not
- Must not decide that a condition of release has been met
- Must not choose whether the pension is reversionary or who the reversionary beneficiary is
- Must not alter the valuation or tax components, or estimate a market value without objective data
The lawyer checks
- Condition of release evidenced against the current SIS Regulations definition (for example a retirement declaration or proof of age), and the deed permits the pension on these terms
- Start-day valuation based on objective and supportable data, and tax components follow the proportioning rule
- Reversionary terms match the member's estate plan and any binding nomination, and the beneficiary is a dependant
- First-year minimum calculated correctly and the TBAR lodgement date diarised
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
