When to use it

Use when acting for a member, former member (within 12 months) or beneficiary of an APRA-regulated fund who needs the deed, policy, account history or claim file, for example before a TPD or death benefit claim or an AFCA complaint. For an SMSF, the prescribed-document right in s 1017C(5) does not apply; ask the trustee directly.

How AI may be used

AI may complete this approved letter from the client's details and the fund's name and contact details; the request list is settled once at setup, and the lawyer checks only the client and fund particulars and the authority before sending.

AI may

  • Insert the client, member number, fund and trustee details from the file
  • Tick the standard document requests that fit the matter type (TPD, death benefit, account dispute)
  • Diarise the one-month follow-up date and draft the follow-up letter

AI must not

  • Must not add allegations about the trustee's conduct or the merits of a claim
  • Must not send the request without the client's signed authority
  • Must not state that the client is a concerned person if they are not a member, recent former member or beneficiary

The lawyer checks

  • Client is a concerned person (member, former member within 12 months, or beneficiary), or the letter relies on another basis
  • Client authority signed and enclosed, with identification if the fund requires it
  • Correct trustee entity and fund ABN or USI used
