When to use it
Use when preparing an application for a planning permit in Victoria, including the information the guide says should be in the application. The planning scheme for the land is read with it. The scheme was not opened for this checklist.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may assemble plans, title and the fee receipt into the checklist. The lawyer decides whether a permit is required and whether the application is complete.
AI may
- List the documents on the file against the information rows
- Record the zone and overlays only where the lawyer has copied them from the planning scheme
- Flag a VicSmart question that has not been answered
AI must not
- Must not state that a permit will be granted
- Must not describe a New South Wales control as if it applied
- Must not invent a referral authority
The lawyer checks
- The use or development needs a permit and is not prohibited or as-of-right
- The application identifies the land, the proposal, the existing use, the estimated cost, and any registered restrictive covenant
- The responsible authority is identified from the planning scheme. The guide says it is usually the council
- Clause 65 and the Planning Policy Framework are read before any merits comment. They were not opened
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
