How AI may be used
Lawyer-led compliance task. AI may help track the checklist, but it must not generate evidence, and verification of citations must not be done solely by AI.
AI may
- Maintain the matter's AI-use register and remind the team of checklist steps.
- Prepare chronologies, indexes and document summaries permitted by para 9B, from material that is not restricted.
- Draft submissions for a lawyer to verify citation by citation.
AI must not
- Must not generate, edit or rephrase the content of affidavits, witness statements or objector statements.
- Must not draft any part of an expert report without the Court's prior leave.
- Must not be used as the only check that cited authorities exist and are accurate.
The lawyer checks
- Every affidavit and witness statement contains the required Gen AI disclosure.
- Every expert has received the practice note and the UCPR code, and any Gen AI use has prior leave.
- Submissions contain the verification statement and the citations were checked by a person against the source.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
