When to use it
Use when an interest in land in Australia has been, or is being, compulsorily acquired by the Commonwealth for a public purpose. State acquisition statutes are a different matter. The claim forms were not opened.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may list the interests and the documents on the file against the factors the Finance page names. The lawyer assesses compensation.
AI may
- Enter the interest, the owner and the date of acquisition from documents the lawyer identifies
- List invoices for removal or professional costs, without adding them up as the claim
- Flag whether the file is a section 67 claim or a section 97 claim, once the lawyer says which
AI must not
- Must not state the amount of compensation
- Must not complete the claim form
- Must not apply a state acquisition Act
The lawyer checks
- The acquisition is a Commonwealth compulsory acquisition, not an acquisition by agreement and not a state matter
- Each factor on the Finance page is addressed or marked as not arising
- The section 67 form is used for compensation for compulsory acquisition of an interest, which the page links to section 41. The section 97 form is for loss from Commonwealth activity on the land before acquisition
- The guide to acquisitions and the section 48 notice were not opened and are read before the claim is lodged
