When to use it

Use when a person is commenting on a detailed statement a federal agency has made available to the public. Do not use it to decide that a proposal is a major Federal action, or as a sworn statement.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

Yellow: the lawyer takes the addressee, the deadline, and the facts from the agency's notice and the commenter's instructions.

AI may

  • Lay out comments against the detailed-statement elements in 42 U.S.C. § 4332(2)(C).
  • Leave the deadline, docket, and addressee blank until the agency's notice supplies them.
  • Keep the commenter's identity as a placeholder.

AI must not

  • Do not state a comment period in days. The opened statute does not state one.
  • Do not decide that the action is a major Federal action or that it significantly affects the environment.
  • Do not call the document a draft or final environmental impact statement. The opened section does not use those words.
  • Do not add a statement under penalty of perjury.

The lawyer checks

  • Take the address, the deadline, and any docket number from the agency's own notice.
  • Confirm each factual comment with the commenter.
  • Do not define lead agency, major Federal action, or special expertise. Those definitions were not opened.
  • Read 5 U.S.C. § 552 before describing how the public obtains the statement. That section was not opened.
