When to use it

Use when a permit may lapse, or the owner or occupier asks for more time to start or finish. Copy the expiry from the permit before using a default period.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may copy the dates printed on the permit and count the request window from the expiry date the lawyer enters. The lawyer decides whether to ask for an extension.

AI may

  • Enter the commencement and completion dates printed on the permit
  • Calculate six months and twelve months from the expiry date the lawyer identifies
  • List works the file shows have started, with the date

AI must not

  • Must not state that the permit is still in force
  • Must not apply a default period where the permit states its own
  • Must not decide the Kantor considerations

The lawyer checks

  • The expiry on the face of the permit is used first
  • The request is by the owner or occupier, or by another person with the owner's written consent
  • The request is inside the six-month or twelve-month period the guide states, or it is recorded that the authority has no power to extend
  • A refusal or a failure to decide within one month is noted as a possible VCAT review. Section 81 was not opened

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
