Where this comes from

The official form is published by magistratescourt.wa.gov.au; this page is a completion guide. Last checked on 2026-10-22.

When to use it

Use when preparing an application in the Magistrates Court of Western Australia for a family violence restraining order or a violence restraining order under the Restraining Orders Act 1997 (WA). The behaviour summary is filed content. A tool must not write it.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may check the application against the Court's PDF and list gaps; the lawyer writes the summary of the respondent's behaviour and every ground. No form number is printed in the title.

AI may

  • Check the draft against the current form and list blank fields, missing copies and inconsistent names
  • Index dates, police incident numbers and existing orders already recorded on the file, without rewriting the account of what happened
  • Flag address and contact fields that should be kept off a document the other party will see

AI must not

  • Must not write the narrative of incidents or any statement in support
  • Must not describe the abuse, the risk, or the conditions sought, in words the lawyer and applicant have not settled
  • Must not sign, file or serve the application

The lawyer checks

  • The current form is used, and it is the family-violence form rather than a non-family restraining or personal protection form, or the reverse, as the facts require
  • Confidential addresses are not on a document the other party will receive
  • The lawyer has checked the current practice direction before any generative tool is used

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
