Where this comes from
The official form is published by localcourt.nsw.gov.au; this page is a completion guide. Last checked on 2026-10-17.
When to use it
Use when acting for a person seeking an ADVO where police have not applied. If the person in need of protection is a child under 16, only police can apply. Where there is immediate danger, police (000) come first.
How AI may be used
Lawyer-led. The written statement is the applicant's own evidence and the Local Court has adopted SC Gen 23, which bars Gen AI from generating or rephrasing it. AI may only index annexures and check the lawyer's draft against source documents.
AI may
- Index annexures and exhibits and list any document the draft refers to that is not annexed
- List facts in the lawyer's draft that have no source in the proofing note or documents
- Check the statement against the practice note's form requirements and the timetable dates
AI must not
- Must not write, complete, smooth or rephrase any part of the applicant's statement (SC Gen 23 para 12)
- Must not enter the protected person's address, intended address, workplace, children's schools or safety plan into any AI tool
- Must not fill gaps in the applicant's account from police material
- Must not draft non-standard conditions
The lawyer checks
- The statement is in the applicant's words and contains the SC Gen 23 para 13 disclosure
- No residential address appears in the application unless s 43 permits it
- Conditions sought are necessary for safety and fit the s 35 list
- Interaction with any family law orders, criminal charges or cross-applications
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
