When to use it
Use when a NSW coroner has dispensed with an inquest and the client wants the reasons under s 26, usually before asking the State Coroner for a direction or applying to the Supreme Court.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may insert the coroner's reference and the date of the dispensation; the lawyer writes the interest and sends the letter.
AI may
- Insert the deceased's name, the coroner's reference and the date of the letter dispensing with the inquest
- List documents already sent to the coroner, by date
AI must not
- Must not argue that an inquest should be held
- Must not include an account of the death
- Must not send the letter
The lawyer checks
- The letter asks for reasons and states the interest, and does not try to be the submissions
- The client has approved the description of their interest
- The reply, or a refusal, is diarised for the s 29 and s 84 steps
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
