When to use it
Use when assembling the responsible lending file for a consumer credit contract, or an increase in the credit limit, before the contract is entered.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool slots document titles and dates into the section 130 rows, and the licensee writes whether the contract will be unsuitable.
AI may
- Enter the document title and date for each inquiry the licensee has already collected.
- Enter the proposed credit day and count back 90 days, for the licensee to check.
AI must not
- Do not tick that the contract is suitable or unsuitable.
- Do not make an unconditional representation that the consumer is eligible.
- Do not enter the contract. Section 128 prohibits entry on the credit day unless the assessment and the section 130 inquiries were made within the prior period.
The lawyer checks
- The period in section 128 is 90 days, or another period prescribed by the regulations. The regulations were not opened.
- Apply section 131(2): likely inability to comply, or compliance only with substantial hardship, or the contract will not meet requirements or objectives, or circumstances prescribed by the regulations.
- Section 131(4) limits the information that is taken into account. Part 3-2BA for low cost credit contracts was not opened.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
