A borrower’s payout request to an outgoing lender and a deed by which the lender, on receiving the payout amount, releases the borrower and guarantors, discharges its security, removes PPSR registrations and delivers title documents and mortgage discharges.

When to use it
Use when a facility is being repaid or refinanced and the incoming lender or buyer needs clean title at settlement. Many banks insist on their own discharge forms for land mortgages; use this deed for the overall release and the personal property security, and attach or refer to those forms.
How AI may be used
AI may list every security, guarantee and registration to be released from the security schedule and search results and fill them into the deed, but a lawyer confirms the list is complete and the payout figure and conditions are agreed before settlement.
AI may
- Build Schedule 1 from the finance documents, the security register, PPSR searches and title searches
- Fill the parties, facility, payout date and account details into the payout letter and deed
- Reconcile the outgoing lender’s payout figure with the loan statements and list differences for the lawyer
AI must not
- Must not confirm the payout figure, daily interest or break costs; those come from the lender and are checked by a person
- Must not change bank account details for the payout from anything other than verified written instructions confirmed by phone on a known number
- Must not omit guarantees or third-party security because they are not on the PPSR
The lawyer checks
- Schedule 1 lists every security interest, mortgage, guarantee and PPSR registration, including third-party security and all-moneys securities that might secure other debts
- The release is unconditional on receipt of the payout amount, and the outgoing lender confirms no other facility is secured by the same security
- Payment details have been verified independently before funds are sent
- Land mortgage discharges in the lender’s approved form, title documents and PPSR financing change statements are available at or promptly after settlement
