When to use it
Use for a grantor, buyer, financier or other person with an interest in collateral where a PPSR registration remains after the debt is repaid, never secured anything, or covers collateral that secures nothing, for example before a refinance, sale or settlement. Ask informally first if the secured party is cooperative.
How AI may be used
AI may fill the demand from the PPSR search result and the discharge evidence and keep the deadline diary, but a lawyer confirms the demand is authorised under the s 178 table before it is sent or escalated to the Registrar.
AI may
- Copy the registration number, secured party, grantor and collateral class exactly from the PPSR search certificate into the demand
- Prepare the deadline diary from the date the demand is given (5 business days, then the Registrar steps)
- List the evidence on file that the obligation is discharged or that the collateral secures nothing
AI must not
- Must not decide that no collateral secures an obligation, or that particular collateral secures nothing
- Must not lodge a statement with the Registrar or make any statement in the approved form for the client
- Must not retype registration numbers or grantor details from memory; copy them from the current search
The lawyer checks
- The person giving the demand has an interest in the collateral, and the amendment sought is authorised by item 1 or item 2 of the s 178 table
- There is evidence the secured obligations are discharged or never arose, including any all-moneys or cross-collateral clauses
- The demand is given to the secured party at its address for service on the PPSR, and the date it is given is recorded
- Before any statement to the Registrar, its contents are accurate, since false or misleading information may be an offence
