When to use it

How to use this precedent
Check that it fits the matter: read “When to use it” and the places it applies to.

Adapt it to the matter, filling in each placeholder shown in [square brackets].
Use AI only as far as the Yellow level allows. “How AI may be used” says what AI may and must not do.
Before it goes out, a lawyer checks it against current law and each point under “The lawyer checks”.
How AI may be used
A tool may map the firm's AI tools to each statutory duty and list gaps. A lawyer decides whether a tool's access is restricted under 6068.1(a)(3)(A) and signs off the checklist.
AI may
List the firm's AI tools and the matters they are used on, from the firm's own register
Mark each tool against the duties in sections 2 to 6 and flag a duty with no control
Draft staff reminders that quote the statute accurately
AI must not
Must not decide that a tool's access is restricted to the attorney and authorised persons
Must not mark a citation, a vendor term or a control as checked
Must not treat this checklist as a substitute for the State Bar guidance or any Judicial Council rule issued after 7 November 2026
The lawyer checks
The vendor terms for each tool have been read by a lawyer for who can access inputs, retention and training use
The firm has decided how it will meet the court disclosure duty in 6068.1(a)(3)(C) and recorded that decision
The Judicial Council and the local court have been checked for any rule, form or standard issued after 7 November 2026
