From awards, settlements and insurer letters the lawyer marks, list each payment, who paid it, the date it was received, and whether that date is before the scheme decision or an interim grant. Do not decide that a notice is due.
What the lawyer must review
  • Decide whether the payment is a relevant payment under the section
  • Do not call a payment relevant until you have the definition. This subsection does not supply it.
  • A notice, if one is sent, is settled by the lawyer
  • Use a firm-controlled tool for health records. ASCR r 9, APP 11 and the Privacy Act 1988 (Cth) apply.

The work product

Forum. Victims of Crime Assistance Act 2009 (Qld) s 141A

Produce. A payment list with dates. The lawyer decides whether notice is required.

Have ready. Awards, settlements and insurer letters the lawyer marks; The date of any interim grant or final decision; Section 141A.

Example of the limit. Illustrative example: A settlement is received after the scheme has already decided the application. The list records that the receipt is after the decision. It does not prepare a s 141A notice.

Stop and hand it back when

  • The date of receipt is unknown.
  • The lawyer has not said whether the payment is a relevant payment.

Checklist

  1. Section 141A applies if, before the application is decided under s 89 or interim assistance is granted under s 98, the applicant receives a relevant payment for the act of violence.
  2. Notice to the scheme manager is written or oral, within 28 days after receiving the payment, unless there is a reasonable excuse. The maximum penalty is 100 penalty units.
  3. The opened subsection does not define relevant payment. Do not invent the definition.
  4. The guide's offender-debt recovery is the State asking a convicted offender to repay the State. It is not a demand that the victim repay, and it is not this notice.
