How AI is used
From the approved issues table, build an internal outline of the issues and the procedural sections. Write nothing that is lodged with the Commission or a court, and do not generate the content of a person's evidence.
What the lawyer must review
  • Verify every citation yourself. A generative tool must not do that verification
  • In the Commission, put that verification in the body, as PIC13 paragraphs 18 and 19 require
  • In the Supreme Court and the Local Court, Practice Note SC Gen 23 paragraphs 16 and 17 apply
  • Settle the submissions before lodgement. Do not file an unchecked draft

Checklist

  1. PIC13 paragraph 11(c) allows written submissions to be prepared with generative AI, subject to the later paragraphs. Paragraphs 18 and 19 require the author to verify in the body that citations, authorities and legislative references exist, are accurate and are relevant, and to make a similar verification for references to evidence. That verification must not be carried out by a generative AI tool.
  2. PIC13 paragraph 20 says use of generative AI does not absolve the author's professional obligations. Paragraph 12 says generative AI must not generate the content of a person's evidence.
  3. Practice Note SC Gen 23 paragraphs 16 and 17 require the same verification in submissions or a skeleton. Paragraph 17 says the verification must not be carried out solely by a generative AI tool. The note was issued on 28 January 2025 and commenced on 3 February 2025.
  4. The Local Court practice note issued on 12 December 2025, commencing 12 January 2026, adopts Practice Note SC Gen 23 for all Local Court proceedings.
