Where this comes from
The official form is published by hcc.vic.gov.au; this page is a completion guide. Last checked on 2026-10-23.
When to use it
Use this when the patient writes to the health service on the Commissioner's notification form, before or instead of a longer letter. The 30 working days is the request printed on the form. It is not the online complaint to the Commissioner.
Used for these tasks
- Ask for a correction, or a stored note of disagreement, on a health record
- Request the patient's health records from each service that treated them
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool indexes the notification headings and does not write what happened, the impact, or the outcome sought.
AI may
- Index the patient's name, date of birth and contact, and the clinic and practitioner names, from the file.
- List the supporting documents already held, using the categories printed on the form.
AI must not
- Do not write the issues narrative or the desired outcome.
- Do not change the form's request that the provider respond within 30 working days, and do not call that period a statutory limit.
- Do not attach original medical records if the client has not agreed. The form says to attach copies.
The lawyer checks
- The about-complaints page publishes this document next to the longer letter template. Confirm with the client which one is being sent.
- The form's examples of an outcome include access to or correction of records. A separate health-records request may still be required.
- The form asks the provider to say why a response within 30 working days cannot be met, and the expected timeframe. That is a request on the form.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
