Ask for a correction, or a stored note of disagreement, on a health record
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the passage the patient disputes and the correction the lawyer has settled, draft the request that asks the holder to correct the record or, if the holder will not correct it, to keep the patient's statement with the record, and state the time limit the opened path gives. Do not assert that the record is wrong.
- What the lawyer must review
- The lawyer settles the wording of the correction and decides whether to ask for one.
- The request asks for a correction or a stored statement. It does not rewrite the record.
- Health information stays in a firm-controlled tool, not a public one.
- Use the time limit of the path that was opened, and no other.

Who does what
| Role | What they do |
|---|---|
| Assistance | From the passage the patient disputes and the correction the lawyer has settled, draft the request that asks the holder to correct the record or, if the holder will not correct it, to keep the patient's statement with the record, and state the time limit the opened path gives. Do not assert that the record is wrong. |
| Lawyer | Set the scope, supervise the work closely, verify every part relied on, resolve omissions and exceptions, and approve the exact output. |
Checklist
- Ask for a correction or for the statement to be stored. Do not ask the holder to erase a Victorian private-sector record. The Commissioner says it cannot be erased.
- In New South Wales, if the draft assumes the holder will refuse, include the request to attach the patient's statement under Health Privacy Principle 8(2).
- In Queensland, call the request an amendment application under the Right to Information Act, and diary 20 business days for a review of a formal decision, not for the first answer.
- Do not state as a fact that the note is wrong. The lawyer settles that wording.

These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
Health information stays in a firm-controlled tool. Rule 9.1 of the Legal Profession Uniform Law Australian Solicitors' Conduct Rules 2015, as described by the Victorian Legal Services Board and Commissioner, and APP 11, apply. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).
The amendment principle in the Privacy Act for an APP entity was not opened. The lawyer uses the State path that was opened where it applies.
