Where this comes from
The official form is published by hcc.vic.gov.au; this page is a completion guide. Last checked on 2026-10-23.
When to use it
Use this when a patient, or a family member with the patient's consent, complains to the Health Complaints Commissioner about a health service in Victoria. Raise it with the provider first where that is possible. Urgent matters are lodged by phone.
Used for these tasks
- Index a health-complaint file for material the damages claim cannot use
- Index the issues and records for a response to a health-complaints body
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool indexes the documents the complaint needs and does not write the complaint narrative or lodge the webform.
AI may
- List the provider's name and address, the letter already sent to the provider, and the provider's reply, if they are on the file.
- Diary that the webform cannot be saved and logs out after 30 minutes, and that an urgent complaint is made by phone.
AI must not
- Do not write the account of what happened, the impact, or the outcome sought.
- Do not lodge the webform, and do not tick that the patient has consented.
- Do not decide that the Commissioner will refer the complaint to Ahpra.
The lawyer checks
- The about-complaints page says to raise the concern with the provider first where possible. A hospital billing or treatment complaint is usually handled by a complaint liaison officer. A health-records complaint is usually handled by the health-records or freedom-of-information officer.
- Phone 1300 582 113. The about-complaints page says 9.30am to 3.00pm, Monday to Friday. Mail is GPO Box 4057, Melbourne, Victoria 3001. An interpreter is through TIS National on 131 450.
- The make-a-complaint page says the webform takes 15 to 20 minutes, cannot be saved as you go, and logs out after 30 minutes. The submit address is on that page.
- Complaining for someone else needs that person's consent. An anonymous complaint limits what the Commissioner can do, and the person receives no updates.
- The page says a complaint about a registered provider may be referred to Ahpra. The lawyer decides whether a damages claim and this complaint can run together, and what from the complaint file cannot be used in the damages claim.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
