Where this comes from
The official form is published by hcc.vic.gov.au; this page is a completion guide. Last checked on 2026-10-23.
When to use it
Use this when the concern is complex or serious and the about-complaints page says to put it in writing to the provider. The template's 20 working days is an example of a timeframe, not a statutory limit. Lodge with the Commissioner if the provider's reply is not satisfactory.
Used for these tasks
- Ask for a correction, or a stored note of disagreement, on a health record
- Index a health-complaint file for material the damages claim cannot use
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool indexes the letter headings and does not write the problem, the impact, or the outcome the patient wants.
AI may
- Index the provider's name, position and address, and the date the patient first knew of the problem, if the file already records it.
- List the copies on the file that the template says may be attached, without describing their contents.
AI must not
- Do not write the explanation of the problem, the impact, or how the patient wants it resolved.
- Do not sign the letter.
- Do not treat 20 working days as a statutory time limit. The template gives it as an example.
- Do not send original documents. The template says to send copies.
The lawyer checks
- The about-complaints page says to try the provider first, and that a provider may take up to three months to respond after acknowledging the complaint.
- The template says to remove its heading from the final copy, and that the writer may say the next step is a complaint to the Health Complaints Commissioner.
- A request for correction of a health record can be one outcome. Check whether the health-records request is also required.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
