When to use it

Use when the franchisee will lease or occupy premises from the franchisor or an associate, or must enter another agreement as part of the franchise. It does not draft the lease.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may list the lease and the other agreements on the file and the dates they were given, and the lawyer decides whether the page's timing has been met.

AI may

  • List each lease, occupancy arrangement and other agreement the file contains
  • Record the date each was given to the prospective franchisee or the franchisee
  • Count 14 days before entry, one month after signing or occupation, and 7 days after a request

AI must not

  • Must not decide that a person is an associate of the franchisor
  • Must not draft a lease, an incentive disclosure, or a retail-tenancy statement
  • Must not treat state retail-tenancy disclosure as satisfied because this page was checked

The lawyer checks

  • The premises arrangement is a lease or sublease from the franchisor or an associate, or occupation without a lease
  • The documents the page lists for that arrangement were given by the time the page states
  • Other agreements were given when they became available, or at least 14 days before the franchise agreement was signed
  • State or territory retail tenancy disclosure is checked under that law
