When to use it
Use when a franchisor creates its disclosure document, carries out the annual update, or a lawyer reviews one. Use the ACCC’s model disclosure document guidance alongside it. Not for franchise agreements entered into before 1 April 2025 that remain under the old code’s transitional rules.
How AI may be used
Lawyer-led. AI may build the item register and record which source document supplies each item. Every statement, especially earnings, financial and litigation disclosures, is verified by the franchisor and lawyer.
AI may
- Build the item-by-item register under the Code edition the lawyer names and record the source paper for each item
- Flag items with no source, inconsistent figures, or required statements missing
- Compare this year’s draft with last year’s disclosure document and list changes
AI must not
- Must not draft earnings information, solvency statements or litigation disclosures
- Must not decide that an item is "not applicable"
- Must not process franchisee personal information or financial reports in an unapproved tool
The lawyer checks
- Every Schedule 1 item is answered or listed in the "not applicable" attachment
- Earnings information meets item 20 and has reasonable grounds
- Document signed, dated, with a table of contents, and the Register updated
