When to use it

Use when a franchisor is creating a register profile before entering a franchise agreement, or confirming or updating the profile after the end of a financial year.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

The tool enters the profile fields from instructions and counts the annual date from the financial year the lawyer enters, and the lawyer checks that sections 92 and 93 apply before anything is published.

AI may

  • List the section 92(2) fields and mark each one supplied or missing.
  • State the 14-day period in section 92(3)(b) and the 14th day of the fifth month in section 93(3)(c).
  • Record the ACCC's worked example of 14 November for a franchisor whose financial year ends on 30 June.

AI must not

  • Do not lodge the profile.
  • Do not state a penalty in dollars. The sections say 600 penalty units.
  • Do not say every master franchisor must be on the register. Section 92(1)(d) and section 93(1)(b) qualify a master franchisor.

The lawyer checks

  • Decide whether section 92(1) or section 93(1) applies, including the master-franchisor condition of two or more subfranchisors.
  • The Secretary's approved form, and any determination under section 92(4) or section 93(4), were not opened.
  • The ACCC page says a new form changes how information is provided. That form was not opened. Use the fields in section 92(2) and check the current form.
