From the internal review notice and the documents already lodged, list the decision, the date the person was told of the internal review outcome, and the documents the lawyer marks. Do not write the grounds and do not write anything that is lodged.
What the lawyer must review
  • You write the grounds. The list is not the NCAT application
  • Limit this path to a recognition payment after internal review. It is not every victims decision.
  • Treat restitution review as the defendant's step, after a written objection.
  • Use a firm-controlled tool for health records. ASCR r 9, APP 11 and the Privacy Act 1988 (Cth) apply.

The work product

Forum. NSW Civil and Administrative Tribunal, Administrative and Equal Opportunity Division, recognition payments

Produce. A list of the internal review outcome, the date the person was told, and the documents. The lawyer writes the grounds.

Have ready. Internal review notice; Documents already lodged; Procedural Direction 7.

Example of the limit. Illustrative example: The person was told of the internal review outcome on 1 March. The list records that date and Legal Aid's 28-day period. It does not draft the grounds, and it does not open a review of an economic-loss decision.

Stop and hand it back when

  • There has been no internal review of a recognition payment.
  • The date the person was told of the outcome is not on the file.

Checklist

  1. NCAT's page says it can review a decision about a recognition payment after Victims Services has internally reviewed it, in the Administrative and Equal Opportunity Division.
  2. Legal Aid NSW says that NCAT application is made within 28 days from when the person is told about the internal review outcome. The NCAT case-type page that was opened does not itself state that number of days. Confirm it on the current form.
  3. Legal Aid NSW says an internal review application is within 90 days of being told of the decision. That is the prior step. Do not prepare a victim's NCAT review of an immediate-needs or economic-loss decision on these pages.
  4. A restitution order against a defendant is reviewed only after that defendant lodges a written objection. Do not prepare that application for the victim.

Sources

Legal Aid NSW says a further appeal from NCAT to the Supreme Court is for legal error and cannot reconsider the merits. The appeal must be filed within 28 days of the date of the decision. An extension may be available in limited circumstances.

Procedural Direction 7 commenced on 7 April 2025 and applies to all proceedings. It allows a generative tool to prepare an index or a summary. It must not generate the content of evidence. If it is used in written submissions, citations must be verified in the body, and that verification must not be done only by the tool. The list from this task is not the submission.

Paragraph 9 says material under a non-publication order, a statutory restriction on disclosure, or produced on summons must not be entered into a generative tool unless the controlled-environment conditions in that paragraph are met.
