Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the audiograms and the employment history the lawyer supplies, using a firm-controlled tool, table the dates, the figures the reports state, the employers and the exclusions the pages name. Do not convert a figure to a degree of permanent impairment.
- What the lawyer must review
- You decide whether the hearing loss is claimed, and against which employment.
- Do not convert an audiogram figure. Section 125(3) requires at least five years of employment in the State.
- Apply the pages' exclusions, kept separate from section 125(4)'s first 5% of diminution of hearing.
- Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.

Example of the limit. Illustrative example: An audiogram states a binaural figure and the history shows six years of noisy Queensland work plus two years self-employed. The table records both periods and the self-employment exclusion. It does not convert the figure.
Stop and hand it back when

WorkCover says a person who is not working can still claim if they would usually be working, or retired less than a year ago, and that the claim needs a diagnosis, a work capacity certificate, and five years or more of Queensland work where noise contributed. WorkSafe describes the work test as five years or more in a job where noise was a factor. Both pages say compensation is a lump sum. WorkCover says the degree of permanent impairment can be 0 per cent. Both pages say the offer takes account of loss outside Queensland or while self-employed, 5 per cent of hearing loss that occurs naturally, and hearing loss already counted in previous assessments. The pages say a further claim can be made every three years if hearing gets worse, with the same exclusions. WorkSafe ties that further claim to first accepting the offer.
WorkSafe says damages as well as the lump sum are open only if the degree is 20 per cent or more, and that a degree between 5 and 19 per cent requires a choice of the lump sum or damages. A tribunal decision on industrial deafness is final and cannot be appealed. Section 125(3) requires at least five years of employment in the State at a location where the noise level was a significant contributing factor. Section 125(4) bars lump sum compensation for the first 5% of diminution of hearing. That bar is separate from the pages' exclusion for 5% of hearing loss that occurs naturally. Section 126 allows a further application only if it is lodged more than three years after the previous application was lodged, and further lump sum compensation only for a further diminution of more than 1%. The guidelines' hearing section was not opened, so the conversion from the audiogram is not done here.
