How AI is used
From the firm's conference checklist and the support needs the lawyer has marked, prepare a plan of who may attend, breaks, and which records to collect before any account is taken. Write none of the client's account.
What the lawyer must review
  • The lawyer takes any account. Do not let the plan become a draft the client adopts.
  • Do not treat the guidelines as binding. They follow the Act's definition of child abuse.
  • Check any confidentiality clause against the guideline before the client is asked to accept it.
  • Keep the file in the firm's system. Confidentiality and APP 11 apply.

Checklist

  1. The November 2022 guidelines are not binding. They say they apply to child abuse as they define it, following the Civil Liability Act: sexual or serious physical abuse, or connected psychological abuse.
  2. They say the State should minimise re-traumatisation, train lawyers in a trauma-informed framework, consider resolving a matter without a statement of claim, and offer an apology where the State has acted improperly, ordinarily by a senior executive.
  3. A confidentiality clause is considered case by case and, if used, should not stop the claimant discussing the circumstances of the claim and the claims process.
  4. The State will help identify the proper defendant. The plan does not summarise the client's account.

Sources
