How AI is used
From the firm's conference checklist and the support needs the lawyer has marked, prepare a plan of who may attend, breaks, and which records to collect before any account is taken. Write none of the client's account.
What the lawyer must review
  • The lawyer takes any account. Do not let the plan become a draft the client adopts.
  • Check that the principles are used only as non-binding guidance for State child-sexual-abuse claims.
  • Do not apply them of themselves to a church or a private school.
  • Keep the file in the firm's system. ASCR r 9 and APP 11 apply.

The work product

Forum. Victoria. A first conference in the firm. The principles are for departments responding to claims connected with State institutions.

Produce. A conference plan covering support, breaks and the records to collect before an account is taken.

Have ready. The lawyer's support notes; Whether the defendant is the State; The records already held.

Example of the limit. Illustrative example: The defendant is a private school. The tool lists the records to ask for and does not say the State's principles bind the school. It writes none of the client's account.

Stop and hand it back when

  • The plan starts to summarise the abuse.
  • The client is asked to sign or adopt the plan.

Checklist

  1. The Common Guiding Principles are not binding. They inform responses to civil claims of child sexual abuse connected with State institutions.
  2. They say departments should be mindful that litigation may be traumatic, should ordinarily not require a confidentiality clause, and should offer a written apology where they consider it appropriate.
  3. They say departments should develop pastoral letters that acknowledge claims. They do not promise access to records.
  4. The plan lists records to collect. It does not summarise what the client says happened, and it is not a document for the client to sign.

If the defendant is not the State, do not present the principles as applying of their own force.
